The word aggravate is legal way of saying “to make worse.” If you are being charged with an Aggravated DUI you are essentially being charged with a DUI, except your violation was particularly egregious. In Oklahoma that means your BAC was above or equal to .15%. It doesn’t even matter if it is your first offense, a high BAC could earn you the higher charge.
An aggravated DUI has all the same penalties as a regular DUI but has the added mandatory penalties upon conviction:
