DUI In Oklahoma

The word aggravate is legal way of saying “to make worse.” If you are being charged with an Aggravated DUI you are essentially being charged with a DUI, except your violation was particularly egregious. In Oklahoma that means your BAC was above or equal to .15%. It doesn’t even matter if it is your first offense, a high BAC could earn you the higher charge.

An aggravated DUI has all the same penalties as a regular DUI but has the added mandatory penalties upon conviction:

  • Not less than one (1) year of supervision and
  • periodic testing at the defendant's expense; and
  • an ignition interlock device or devices, for minimum of ninety (90) days.

  • Even though an Aggravated DUI is a serious charge, it isn't treated the same as a felony. If this is your first DUI, it is still categorized as a misdemeanor. However, your case will most likely be filed in county court rather than the municipal court.
